1. Scope (1. Geltungsbereich)
These Terms and Conditions apply to all contracts concluded via the online shop www.soleum.art between Kleinbirken GmbH and the customer.
2. Conclusion of Contract (2. Vertragsschluss)
The presentation of products in the online shop is not a legally binding offer. By clicking “Buy now” / “Complete purchase”, the customer submits a binding offer to purchase the selected goods. The contract is concluded when Kleinbirken GmbH sends the order confirmation by e-mail.
3. Prices and Payment(3. Preise und Zahlung)
All prices are stated in Euro and include the statutory German VAT. Shipping costs are shown separately and are borne by the customer. Payment is due immediately upon conclusion of the contract.
4. Delivery and Shipping (4. Lieferung und Versand)
Delivery is made to the delivery address specified by the customer. Delivery times are stated on the product page or in the order confirmation. Kleinbirken GmbH is entitled to make partial deliveries.
5. Retention of Title (5. Eigentumsvorbehalt)
The goods remain the property of Kleinbirken GmbH until full payment has been received.
6. Warranty and Liability (6. Gewährleistung und Haftung)
The statutory warranty rights apply. Kleinbirken GmbH is liable only for intent and gross negligence. Liability for slight negligence is excluded except in the case of injury to life, body or health.
7. Right of Withdrawal (7. Widerrufsrecht)
Consumers have a right of withdrawal in accordance with the separate Right of Withdrawal Policy. The policy forms an integral part of these Terms.
8. Data Protection (8. Datenschutz)
The processing of personal data is governed by our separate Privacy Policy.
9. Final Provisions (9. Schlussbestimmungen)
German law applies exclusively. The place of jurisdiction for merchants, legal entities under public law and special funds under public law is Düsseldorf. Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

Right of Withdrawal(Widerrufsbelehrung) / Cancellation Policy for Consumers(Widerrufsbelehrung für Verbraucher)
You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Kleinbirken GmbH, Nürnberger Str. 12, 40599 Düsseldorf, Germany, info@soleum.art, Phone: +49 151 67528371) of your decision to cancel this contract by means of a clear declaration (e.g. a letter sent by post or e-mail).
You can use the attached model withdrawal form, but this is not mandatory.
Consequences of cancellation(Folgen des Widerrufs)
If you cancel this contract, we will reimburse all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received notification of your cancellation. For this repayment we will use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send back the goods before the expiry of the 14-day period.
You shall bear the direct costs of returning the goods.
Exceptions to the right of withdrawal(Ausschluss des Widerrufsrechts)
The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (e.g. custom-made artworks).
